1. Acceptance
These Terms of Service ("Terms") govern your access to and use of the AetherForge website and any related early-access services (together, the "Service"). By accessing or using the Service, you agree to these Terms and to our Risk Disclaimer and Privacy Policy. If you do not agree, do not use the Service.
2. Who we are
The Service is operated by AetherForge ("we", "us", "our"), an independent, self-funded early-stage project based in Japan, run by an individual founder based in Japan. AetherForge is not a registered company.
3. The Service
AetherForge provides crypto strategy research, backtesting, signal monitoring, risk reports, data pipelines, and related tools. The Service is in an early, pre-launch stage. Features may be added, changed, suspended, or removed at any time, and access is currently offered on a limited, waitlist basis.
4. Not financial advice
The Service is for research, informational, and educational purposes only and does not constitute financial, investment, trading, legal, or tax advice, or a recommendation or solicitation to transact in any asset. We do not execute trades, manage funds, or take custody of assets. You are solely responsible for your own decisions. See the full Risk Disclaimer.
5. Eligibility
You must be at least 18 years old and legally able to enter into these Terms. You are responsible for ensuring your use of the Service is lawful in your jurisdiction.
6. Waitlist and early access
Joining the waitlist does not guarantee access to the Service or any particular feature, timeline, or service level. Early-access functionality may be incomplete and provided for evaluation.
7. Acceptable use
You agree not to misuse the Service, including by: violating any law; attempting to disrupt, attack, or gain unauthorized access to the Service or its infrastructure; scraping or reselling our content without permission; or using the Service to harm others.
8. Fees
The Service is currently offered free of charge. If we introduce paid features in the future, they will be governed by additional terms presented at that time.
9. Intellectual property
The Service, including its content, design, text, and software, is owned by AetherForge or its licensors and is protected by applicable laws. You may not copy, modify, distribute, or create derivative works from it except as permitted by law or with our written consent.
10. Third-party data and links
The Service may rely on or link to third-party data and websites, which are provided "as is" and which we do not control or endorse. We are not responsible for third-party content, data accuracy, or availability.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by applicable law, AetherForge and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, capital, data, or trading losses, arising out of or related to your use of (or inability to use) the Service.
13. Indemnification
You agree to indemnify and hold harmless AetherForge and its operator from claims, damages, and expenses arising out of your use of the Service or your breach of these Terms.
14. Termination
We may suspend or terminate access to the Service at any time, with or without notice. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and intellectual property) will survive.
15. Governing law and jurisdiction
These Terms are governed by the laws of Japan, without regard to conflict-of-laws principles. You agree that the Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute arising out of or relating to these Terms or the Service.
16. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
